Rights in the VVT collective labor agreement: Work assignments and overtime

Questioner

I fall under the VVT collective labor agreement. - May work orders be given by my employer? And what are my employer's rights if I refuse? - In case of illness of a colleague, the rest of the team is expected to solve these services (ad hoc). The hours that are worked extra, will be scheduled less in the next schedule (three months later). Am I entitled to extra compensation in money for the hours that I work on a day that I was not actually scheduled?

Lawyer

As an employee, you must comply with a reasonable request from the employer. If you are not scheduled, this counts as overtime. Ad hoc services can therefore be claimed from the employer as overtime. If you wish, you can contact us without any obligation.

Questioner

Thank you for your quick response, However, my second question is not entirely clear. Do these services fall under 'shifted service' or 'overtime'? See article 5.15 and 5.16 in the CAO VVT. Our schedule is planned about three months in advance. For example, if I have to come to work tomorrow due to illness, these will be plus hours on the schedule. These hours will be deducted from the hours to be worked in a subsequent schedule, yet to be planned. My employer is of the opinion that in this case I am not entitled to additional compensation as referred to in Article 5.16 paragraph 4.

Lawyer

Assuming that the working hours scheme is set for three months, when you are called up you will work more than the agreed working hours according to the working hours scheme and the hours will be regarded as overtime on the basis of 5.16. A shift is when the working hour is moved. A new hour is not a shift. For working overtime, you are legally entitled to at least 25% of your salary. You can therefore claim this from your employer. If you wish, you can contact us without any obligation.
