Situation: I received a letter from the tax authorities with a decision of 3500 euros. Because I apparently had no right to rent and care allowance in 2016. During a telephone conversation with the tax authorities it was explained that I had too much income (through uwv). I paid this (too much uwv) back in January 2017. But that will not be deducted in 2016. Is this possible? Are they allowed to do this? Kind regards.Lawyer
The Tax Authorities, Allowances department (BDT) may reclaim overpaid allowance. In this case it is very unreasonable -> objection. If the objection to the BDT is declared unfounded -> hold the UWV liable for the damage. Allowances -> very complex matter. Especially because the BDT works very poorly, slowly and carelessly.
