Contractor liability in case of leakage

In 2005 we bought a new-build home. In the past 12 years there was always leakage through the roof. This was repaired by the contractor. Now after 12 years we are suffering from a rotting roof and still have leakage. The contractor states that he is no longer liable, since the 10-year guarantee has expired. Can we hold the contractor liable for a serious defect, whereby the bonding of the building is affected?Lawyer
