Legal assistance with car purchase problems

Questioner

I bought a second hand car 2 days ago (€13000,-). I signed an agreement and did not pay anything in advance. I saw the car and drove it. I had no comments. A day later I checked the specification of the car again and it turned out that the advertisement offered a more luxurious version than the car actually was. In all honesty I have to say that I could have seen these differences during the visit, but I did not pay enough attention to them. A day later I realized that I actually wanted to buy a more luxurious version. (probably for a higher price too) All in all, I don't have a good feeling about the agreement. Can I cancel the agreement? The car has of course not yet been delivered, is not yet registered in my name and nothing has been paid yet.

Lawyer

In principle there is an enforceable purchase agreement and as you put it: you should have been able to notice a few things so that you could still cancel the purchase or reduce the price. Now you are actually making an improper appeal to error or non-conformity. I think that the seller will hold you to the purchase, certainly if it is a garage. However, that does not mean that you can still argue that the purchased item lacks the promised properties. Because nothing has been paid in advance, it makes it difficult for the seller, he will then have to assert his rights and that also costs effort and money.
