Legal Assistance with Webshop Reminder

Questioner

In August I bought a bag from a webshop, it was delivered neatly and the invoice was received and paid. Now on October 1 I received a reminder that the amount was too low and that I still have to pay € 95. I do not agree with this, am I within my rights not to pay this?

Lawyer

Based on your explanation, you are within your rights. You must pay the amount for which you originally purchased the bag, unless there is an obvious error by the webshop or an error that you could have known was justified. In that case, a subsequent payment may follow.

Lawyer

You must pay the agreed purchase price. If the invoice and the agreed purchase price do not match, the seller can still claim the unpaid part of the purchase price, as is customary for example with payment in installments. So the question is: did you pay the agreed purchase price? If so, nothing more can be claimed from you. If it is established that you (based on the invoice) have only paid part of the agreed purchase price, then if necessary, if you wish to defend yourself against the 'additional assessment', you will have to state/prove that you could have assumed that you would not have to pay the remaining purchase price if you paid the invoice (on time).
