Building a Canopy? Discover Permit Requirements

I would like to build a canopy in my garden, the canopy is 2.3m high and is attached to the outbuilding. The total length is 7 metres. It is not on the property boundary. Am I then obliged to apply for a permit?Lawyer
Dear questioner, For (re)building, an environmental permit for building is usually required (higher than 3 mtr). Sometimes you do not need an environmental permit. For example, for normal maintenance or placing a dormer window at the back of your home All permit-free situations are listed in Appendix II of the Environmental Management Act (Bor). From which I quote you; (...) 'main building: building, or part thereof, that is necessary for the realization of the current or future destination of a plot and, if more buildings are present on the plot, is the most important in view of that destination'. End of quote Even if you are allowed to build without a permit, you must comply with the rules of the Building Decree 2012 (the building may not pose a danger to residents, users and the environment). You must also comply with the neighbour law from the Civil Code (nuisance, hindrance, etc.).
