Can I cancel my purchase agreement?

Questioner

Dear, I recently signed a purchase agreement. Normally, a purchase agreement requires each page to be initialed and a signature to be present on the last page. Now today I noticed that (on my purchase agreement contract) under the page of the cancellation conditions, the seller has not initialed it. What does this mean? Would it still be possible for me to get out of the contract? Can I still cancel the purchase agreement? I would love to hear from you. Greeting.

Lawyer

Ir/Madam, In answer to your question the following; Initialling an agreement means that one has read the contents and signing indicates that one has agreed to it. In itself this is not an obstacle for you but it is for the other party, because they have signed for something that they have not 'read'. If you enter into a purchase agreement and the other party does not comply, you have the right to terminate the purchase agreement. However, a number of conditions must be met. The condition is that the other party's shortcoming must be able to justify the termination. Furthermore, if compliance is not permanently or temporarily impossible, the authority to terminate only arises if the other party is in default. In addition, you may terminate the agreement out of court if the agreement has not been concluded properly. I hope this information is sufficient and if you wish, you may contact me directly for further information.
