In February 2017, a tiling company installed a tiled floor in the living room and hallway of our new-build home. These are large tiles of 75:75 cm. He used a leveling system for this. After only 3 days it turned out that tiles were loose. We reported this problem immediately. A month later the tiler came to have a look and found with us that 80% of the floor was loose. He was very helpful and said he would solve the problem for us. The adhesive manufacturer also came to have a look and then wrote a report stating that there was a coating on the tiles that had prevented the adhesive from sticking. The tiler then held the tile manufacturer liable. The manufacturer stated that several homes from the same batch had been laid without any problems and attributed the problem to the tiler. We made many inquiries and all the professionals said that the wrong adhesive technique had been used. Both the floor and the tiles should have been glued. We have held the tiler liable several times. But he is not reachable by telephone, has never called himself, only sends emails in which he repeats that he wants to lay again but does not want to cover the material costs. We have given him an ultimatum, want our money back so that we can solve the problem with a reliable party, he does not respond. What can we do now?

Sometimes there are dispute committees for these types of matters, which you can appeal to, provided that the tiler agrees to this / is affiliated with a dispute committee. What does the construction contract with the tiler say about this? For the rest, it seems to me that if you really can't reach an agreement with the tiler, the only option left is to go to the (subdistrict) court.
