Correction of error in summons - Legal Aid
Questioner
I have had a summons served that contains a few errors (dates, crucial spelling error, incorrect production). Can I still correct this before the first hearing of the subdistrict court, for example by deed? If so, how do I do that?Lawyer
I would not serve the summons at the first hearing but have a new summons served by the bailiff. If the summons is not served, no court fees are due. However, the errors you mention do not lead to the summons being null and void. Moreover, the nullity is covered if the defendant appears in the proceedings.Take the next step
