Legal advice for self-employed persons: contracts and rights
Questioner
We were appointed together as two self-employed persons for a project a year ago. This is also reflected in all expressions. The board needed more time to draw up a contract and now wants to offer us a contract for 1 person/self-employed company, model agreement 9015550000-06-2 to prevent employment and wants us to arrange it further among ourselves. Is our reasoning correct that if we are appointed together we are jointly entitled to a contract, otherwise I cannot formally derive any rights from it? How do we ensure a good contract? We prefer not to have the VOF construction, because then you also become liable for your VOF partner with your private assets.Lawyer
I need a bit more information to be able to answer your question properly. And to check which contract is most suitable for you. Based on your data, the following. You are each a ZZP. And each of you individually has been hired for a project with a third party, as far as I understand it. Now the client suddenly wants to see you as one party. That does not seem possible to me and certainly not desirable. If you are both ZZP separately, you should also each receive a (flexible) contract from the client. You should arrange this with your client and not between yourselves. You certainly do not need to enter into a VOF construction for this. I certainly do not recommend that either. If I can be of further assistance to you in drawing up or checking a contract, please do not hesitate to contact me for an initial, no-obligation discussion about your case.Take the next step
