Child's nationality after recognition: Important information

Questioner

My daughter was born in the Netherlands and has Dutch nationality. However, her father is Mexican who has been living in America for 30 years on the basis of a green card. My daughter is now 8 years old and he still wants to recognize her, both in the Netherlands and in America. Both in America and in the Netherlands, what nationality will she or can she get after recognition? Mexican or also eligible for a Green Card/permanent residence in America?

Lawyer

Dear Madam, A child automatically receives the nationality of the mother, if the partner has a different nationality. If your child also wants to pass on the nationality of her father, this is possible if he acknowledges the child before birth. If the child is only acknowledged after birth, the baby will only be able to receive the nationality of the father after three years. After three years, the child could therefore receive Mexican nationality. As for the Green Card, unmarried children of legal immigrants can get a visa. However, they must wait until a visa number becomes available. Things can differ per country, so I would check with the embassy.
