Ir/Madam, I would like to file a complaint regarding the late and incomplete transfer to me of the amount of money collected in my name by the collection agency. They were supposed to claim an amount for me from a debtor, but then did not transfer money to me and charged me costs that I did not agree on in advance. In September 2017 I contacted a collection agency regarding an unpaid claim, which I wanted to submit to this collection agency. On September 28, after the thorough explanation, I was asked by a collection agency to fill out a digital form to enter into a contract of assignment. This collection agency was fully and correctly informed by me of all the details of the case: the case was clear and transparent, the claim amount was clearly stated in the order of the Court, the debtor was known and easy to find and was able to pay the claim. According to the collection agency, the failure to collect has been minimal. Because the website of the collection agency did not contain a clear explanation of the conditions, I contacted the collection agency to inquire about the conditions before I placed my order with the collection agency and filled in its digital form. A verbal and written agreement had been made about the costs, which in my case are linked to the services of the collection agency. Namely, the collection agency submitted a quote for the work to be carried out - we agreed on a fixed price and not a target price. I am afraid of written evidence about the agreements that were made with the collection agency. In the email of 29 September 2017, the collection agency clearly stated that in my case, only the collection costs are linked to the services of the collection agency, which "..... are in addition to the claim and the debtor must pay these....". According to the collection agency, no other costs, above the collection costs, were linked to this collection agency service. I was not informed that any additional costs could be expected. And namely, I placed my order with this collection agency under those conditions. Nettemin, the collection agency subsequently just wrongly increased the price: the other additional costs (a considerable amount) are stated on the final invoice. The collection agency now appeals to the General Terms and Conditions and/or general rates, which in my case no longer apply, because a special offer from the collection agency had been received and other agreements on fixed rates had been made with the collection agency. To justify these additional costs, Juristu wrote to me on January 18th: “...We have delivered a good result for you...”. I would like to point out that every entrepreneur in the Netherlands has an obligation to make an effort. This means that he must perform his work as well as possible. To appeal afterwards to the additional costs regarding “good result” is not justified in this case. I would like to point out that I received the final invoice dated November 29, 2017 too late, without any clear reason, only after three weeks, on December 20, 2017, after my reminders which I emailed to the collection agency. In other words, it turns out that I have been scammed by the collection agency – until now, after more than two months after the collection, my money has not been transferred to me. While my bank account number is known to the collection agency, and the rates for work to be performed were clearly stated in the email from the collection agency of September 2017. I have submitted my complaint to the collection agency. I have had multiple chat sessions with customer service, sent emails and filled in the contact form with a question to find a solution on the website. Unfortunately, my complaint has not been handled (to my satisfaction). Furthermore, there is no information on the website of the collection agency regarding complaints procedure. They are not affiliated with any Dispute Committee where I can submit my complaint (such as KBvG or NVIO). I kindly request you to give me advice - what measures can be taken to resolve the situation? Kind regards,Lawyer
I have read some things and I conclude that double charges are being charged here and that is not acceptable.Questioner

Is it possible to publish an answer on the website? I don't want to get in personal contact with someone I don't know. Maybe someone else can please give an answer to my question?Lawyer
I advise you to hold Juristu liable in writing for all costs that you have to incur and have already incurred and for all damages that you suffer and have already suffered. If not all money has been paid to you, you can also claim this in the liability letter together with any overpaid costs. I am prepared to review all written documents, agreements and correspondence for you and then provide further substantive advice. There is no dispute committee where you can complain about this organization. However, you can take them to court under civil law. Do you have any questions? Please feel free to ask.Take the next step
