Legal Advice on Alimony and Assistance

Questioner

My daughter recently got divorced. When the divorce settlement was drawn up, it was stipulated that the money that she and her ex each had in a savings account would be used to pay the residual debt upon the sale of their home. That there will be a residual debt is certain, given the current housing market. My daughter only receives child support. Now she is in danger of losing her job soon. In connection with this, I have a few questions: 1. If she cannot find work and therefore ends up on social assistance, will child support be considered part of the social assistance benefit; 2. Can her savings that are intended for the repayment of the residual debt be swallowed up by the Social Assistance? If the latter is not the case, does she have to do something special with her savings account to prevent the Social Assistance from doing so later? Please provide your answer and advice.

Child support is considered part of the income when determining the amount of social assistance. For the right to assistance, you may have up to a certain amount of small equity. If the equity is greater, the assistance will lapse. A difficult dilemma in which she finds herself. I advise her to be open with the municipality where she lives and to inquire about the details of the regulations in that municipality and how the municipality deals with them.
