Liability in Bicycle Accidents | Legal Aid

Questioner

I fell with my bike because of a large gap (tiles that are far apart) in a bike path, also the street lamp at that location was broken (I took pictures). I hit my head against a tree that was next to the bike path, because of the fall I went to the doctor's office to make sure that there was no concussion, fractures or anything like that. Initially it turned out that there were only bruises. The result of the fall is, in addition to the bruises, damage to clothing and bike and a few days that I cannot work. Can I also hold someone liable for this?

Lawyer

Depending on the situation, you may be able to hold the road authority, the municipality or the province, liable for the defective road design, because the situation does not meet the requirements that you as a road user may set for it. This is a risk liability. If you have suffered an injury, it is wise to seek advice from an LSA lawyer. You can call me if necessary.

You can hold the road authority liable for the damage. Usually this is the municipality, but sometimes also the province. It is best to send a liability claim to the municipality with a description of what happened and what your damage is. If you need help with this, I can help you with this.
