Questioner

Dear, I have a permanent contract with 12 hours a week. Now it happens sometimes that my manager tells me that I exceed my contract hours in a certain week, for example because of the extra hours I receive on Sunday, so he schedules me under contract hours the following week to compensate. My question is: is this legally permitted?

Lawyer

In principle, an employee may decide for himself when the hours are taken. The employer may only refuse this on the grounds of compelling business interests. The employer will have to demonstrate this. In your case, the employer may not compensate the hours in these ways.
