On July 10th I bought a car with a new MOT. The dealer of the car had the MOT done at another garage, but now, after 4 months, it turns out that this car should never have been approved. It concerns an error that the inspector should and could have seen. Because of this my car is immediately unusable and can no longer be repaired. I paid 800,- for that car. I wondered what my rights are. Can I get my money back and if so who should I go to? The inspector or the dealer? kind regards,Lawyer
Dear questioner, the real question is who should be held liable for the error of the apk inspector. You, the apk inspector or the garage owner/seller? Yourself because you did not have the car inspected sufficiently before purchasing: this option is possible because in this case it concerns a car of little value and there is always something wrong with it; the APK inspector. Possibly, but that is a very unusual way. The most obvious thing to do is to address the seller first. He should have known about the defect and should not have been allowed to sell the car. However, my advice is not to go too far with legal proceedings and incur a lot of costs because they are not in proportion to the value of the car and the purchase price. Try to reach an agreement with the garage owner.Take the next step
