Legal CBD oil: What can and may I do?

Questioner

Ir/Madam, A friend of mine lives in Ghent, in Flanders. I myself am from Utrecht. Recently, my friend A. asked me if I could help her with CBD oil, against the pain in her neck and shoulders. This product contains cannabis, which is legal in the Netherlands but not in Belgium. So she can't just order it herself. She asked me if I would buy it for her and send it to her by mail. I have my doubts if this is legal. Otherwise I would also like to buy it and visit her afterwards, and take it with me by train from Utrecht to Ghent. However, I don't want to end up with a criminal record for 'drug smuggling', while I only want to help a friend with something that is completely legal in the Netherlands. Would it be legal to send it by post from the Netherlands to Belgium? Or take it by train? Just a small amount, a small bottle no bigger than a medicine bottle. If there really is no other option, I can also ask her to come to the Netherlands and buy it herself. But because of her problems with fatigue and overstimulation, traveling is easier for me than for her. That is why it would be ideal if I could send it by post or visit her. To what extent is this legal?

Lawyer

If you would send the CBD oil by post or want to bring it personally, this does not have to lead to major problems. The cannabis oil is not on the opium list and is therefore not punishable to possess or transport within the Schengen countries. Especially if it is also prescribed or advised by a doctor. If you have any doubts, you can keep the bottle in your toiletry bag, for example.
