Questioner

Hi, we have a printer contract (5 years) and this company has now been taken over by another company. Now we want to get out of our contract, is that possible? the contract is in the name of our foundation. It's a business contract!

Lawyer

Terminating a contract is a unilateral act: it is a situation in which two parties have an agreement, but one party wants to get rid of it. The other party often accepts this (think of terminating an employment contract), but can also try to stop the termination via the court. When a contract needs to be terminated, the rules in the contract must first be examined. In the case of long-term contracts (often in the form of a subscription), the contract must also be examined. If there is nothing in it, termination is usually still possible (depending on reasonableness and fairness), but often with a reasonable notice period. It may also be the case that compensation must be paid. Whether this is the case must be assessed on a case-by-case basis.
