Legal questions about leasehold and permits
Questioner
Good afternoon, I bought a house with a piece of leasehold land behind it. On that piece of leasehold land a barn was built in 1987 by the previous residents. If it is the case that the shed was placed there illegally at the time, could I have problems with that 31 years later?Lawyer
Yes with the municipality if the shed can not still be legalized if it is there without the necessary permit. Possibly a permit was needed then and now not.Questioner
Thank you, I will try to find that lease agreement. There is no such thing as a statute of limitations in this case? Thank you for your answer, the leasehold land does not belong to the municipality, but to a private individual. The barn was built with a permit, but instead of being built on private property, it was placed on leasehold land.Lawyer
In that case, the lease agreement should normally provide a solution as to whether prior permission from the owner is required and, if so, whether this is the case. If nothing has been arranged, the leaseholder has the same rights to use and enjoy the land, which also includes the construction of a barn.Questioner
