Bankruptcy Question: Legal Advice and Information
Questioner
After the court ruling, there is a claim against me. An appeal was immediately filed against the ruling. Just before the parties appeared before the court, bankruptcy was filed and granted because the claim of the bankruptcy applicant consists of a sum of 2 amounts (private and BV). The appeal was thus suspended. After a year, the bankruptcy was lifted due to lack of assets. The appeal can now be continued. There is now a risk that bankruptcy will be filed again. My question is whether this is possible, since it is clear that there are no assets. A repetition of the bankruptcy will suspend the case again and the legal process will be obstructed.Lawyer
If it is clear that there are no assets, this is a ground on which a bankruptcy application can be rejected. There is case law to that effect. It is important that there is no doubt about this. After all, the main rule then quickly applies: multiple debts left unpaid? Then you will be in the state of having ceased to pay and the bankruptcy can be declared again.Take the next step
