Compensation at KLM: What are your options?

Last month I flew with KLM to New York. The return flight was delayed by 24 hours due to a defect in the plane. I wanted to file a claim with KLM. Now they say that I am not entitled to compensation, because 1. I flew outside Europe, and 2. because I flew with Delta Airlines. However, I booked with KLM at the travel agency, and my tickets are also from KLM. If KLM 'lends' their flight to Delta, are they no longer liable?
