Help with PGB and Social Assistance | Legal Aid

Questioner

I am going to rent a room with the use of facilities as a boarder from my pgb carer. Due to my illnesses I cannot live independently. Contacted the municipality and they say we live together. But I only have a commercial relationship with my host/caregiver. Now the municipality probably does not want to give me assistance... can this just happen? I can't go anywhere because of this. Aren't there any legal provisions? I am entitled to assistance and since the rent is more than 300, I should not officially be allowed to have my rent reduced... I thought. What is the situation now and what can I do?

Lawyer

In a commercial lease there is no question of cohabitation. However, there may be cost sharing. In a commercial lease relationship, there must be a fair rent. There must also be a written lease agreement. In addition, you may not do too much together. Based on your case, the municipality should provide assistance. Cohabitation is one of the most difficult issues within the social assistance. Much depends on how you have arranged everything exactly. I therefore advise you to contact a specialized social security law attorney as soon as possible. He/she is usually a member of the Specialization Association of Social Security Law Attorneys.
