Help with Camper Purchase: Cancel the Purchase
Questioner
Dear, Two weeks ago I bought a camper for 10,000. The camper was thoroughly inspected, I drove it, looked at it and felt it, the timing belt had been replaced 10,000 km ago, all booklets etc. were included. Seller regularly buys campers from a trade-in camper company. Now had 4 again. Price of 10,000 euros was slightly cheaper than comparable models on Marktplaats of 13,000 but he can offer it cheaper because he bought several at a time. Purchased without warranty. After 1 day small black flies in the camper, after some research it turned out to occur in rotten wood. small piece of vinyl wallpaper removed and there was wet rotten wood. immediately called the seller who offered me 500 euros and asked me to find the leak and let him know if I needed more money for possible material costs. opened the piece further and stopped immediately. camper was soaking wet behind all the vinyl that I removed. Called the seller and told him to leave the 500 euros because this was not possible. I want to cancel the purchase, the seller had to think about his reply and 1 day later he tells me that from now on he wants all communication on paper, and that he is not going to help me.... I know that I buy a second-hand camper, that there is a chance that a switch does not work is fine, replacing the brake disc at the next inspection is also fine, I can expect that. But a camper that is wet and rotting for more than 3/4 behind the vinyl wallpaper goes a bit beyond the name camper. I also had the camper inspected by an independent Bovag company and they reported that this was not something that happened for 1 week but had been going on for months and that any camper farmer should have known this. My question is, can I have the purchase cancelled? If I ask, does the seller have to have the camper repaired at his own expense?Lawyer
You are entitled to a proper camper, even with a second-hand camper. You indicate that the camper is 3/4 rotten behind the vinyl and indicate that the camper has a serious defect that must be repaired by the seller. If he does not do this, you can have the purchase cancelled. If you cannot reach an agreement, I would be happy to look at your case.Lawyer
I do see entrances to annul the agreement due to fraud and error, or to dissolve it due to non-conformity. Or to apply a price reduction for the latter reason (defect/defects). Although the buyer has a duty to investigate, the seller must actually inform you about this defect. What are the total repair costs?Questioner
Total repair costs are around 3 to 3500 euros. Seller is not cooperating and wants all contact to be on paper from now on. He told me he didn't know anything about it, but in my opinion he was a bit too quick to pay the first 500... And yes I did research duty, to my knowledge also done fine. however I can't see through the vinyl... He also does not want to respond to my request to have it repaired, he says everything is done on paper. I want him to fix it and show me proof or overcharge me so I can do it myself.Lawyer
If you have fulfilled your duty to investigate, then it is time to terminate the agreement. At least if you want to do so of course. A solution because you want to keep the camper is possible in the form of a price reduction or compensation on the other hand. You thus have several options. Often, intervention by a lawyer can get the case moving. If you want further help, I can assist you in this case.Take the next step
