Post-Dismissal Commission: Am I Entitled?
Questioner
I have resigned myself, but I am still entitled to commission from previous years. However, this commission is currently not being paid because 2 customers never paid. It is now clear that one customer will never pay. Am I entitled to a commission if I leave this boss??? My contract does not state anything about what happens when the contract is terminated The commission arrangement meant that the profits were divided annually, 70% for the boss, 30% for me. Provided all bills are paidLawyer
Your question cannot be answered properly like this. The text of the employment contract is required for this. In principle, your employer will have to settle with you at the end of the employment relationship if for some reason this is immediately possible, then it must be later. The question is, however, whether you are entitled to commission if the customers do not pay. I cannot say that right away. If you want to have this investigated further, you can send me the employment contract.Questioner
