Legal Advice on Breach of Contract and Liability
Questioner
Day, During a lawsuit I had filed for breach of contract and request for dismissal, my employer was ordered to pay me almost €11,000 net (€17,000 gross). There is a BV with limited liability. The BV is, I suspect, empty, but the director has some private things in reserve. I was the only employee. What are my chances of still receiving what I am entitled to?Lawyer
The director who can also be a manager is in some circumstances personally liable for any debts. Only if he can be seriously blamed can he be held personally liable. It therefore depends to what extent the case you have initiated can be blamed on him and whether there are circumstances that lead to his guilt. There is therefore a chance that you can successfully claim your claim. It also depends on the content of the court ruling to what extent the director is liable.Take the next step
