Termination and Contract Extension: What to Do?
Questioner
Good morning On May 1st, after a one-year contract, I received a 3-month contract. In November I was diagnosed with breast cancer, followed by surgery and 21 radiation treatments. I am now reintegrating. Last week I had to come for an interview, my contract will not be extended. My question, is this allowed?Lawyer
Unfortunately, this is allowed. Your employer is not obliged to keep you employed any longer. They can decide not to extend the contract based on their reasons.Lawyer
A fixed-term employment contract expires by operation of law. The employer does not have to give a reason for this. Unfortunately, nothing can be done about this dismissal. However, the employer must give WRITTEN notice of the end of the contract at least 1 month before the end. If he does not do this, you can claim compensation. If the employer puts it on paper that you are being dismissed because of the illness, then you can take action. If you cannot prove that reason (which is obvious), then that is a problem. For the rest, I would like to wish you all the strength to heal and get well soon.Lawyer
Written notice is not required for contracts of less than 6 months. In your case, it concerns a contract for 3 months.Take the next step
