Legal questions about divorce and assets
Questioner
I inherited a piece of farmland 19 years ago. My husband had to sign that he had no claim to it. 17 years ago I sold the land as a building plot and put the money into our new house. Our marriage seems to be over. My question is what happens if we divorce, do I still have the right to the money that was put in from my side.Lawyer
Dear Madam, This question cannot be answered based on your information. Your husband signed for not having a claim to the land. You then sold it and invested the money in the new house. What is important is how you invested that money in the house at that time and whether or not you are married in community of property. yours sincerely,Lawyer
In addition to the factors mentioned above, it is also important to determine whether a so-called exclusion clause applied to what you inherited. Such a clause should be included in the will of the person from whom you inherited. If an exclusion clause applies, what you inherited and/or what replaced it remains private property, even if you are married in community of property.Take the next step
