Liability insurance: Damage to business laptop?
Questioner
Is damage that I, as a private individual, have caused to my partner's business laptop covered by our private liability insurance?Lawyer
Whether this is reimbursed is stated in the policy conditions. I advise you to look into this, if you cannot figure it out, you can ask a follow-up question via this site. By the way, what do you mean by 'business laptop'? Does the laptop belong to an employer, or is your partner a self-employed person and did she buy the laptop for business purposes? In the first case, the damage should definitely be covered by the AVP policy.Questioner
Dear Rudolf, thank you for your response. The laptop belongs to my partner's BV who is 1/5 shareholder or owner of the BV. He had the laptop in our house when I damaged it. The company (Noordhollandsche) denies the damage and says that it is not covered by the AVP cover. They deny it on the grounds of 'quality' because it was assumed that the laptop was used for the purpose of conducting a business. However, that is not correct and I have presented this to the company (there was no question of conducting a business when the damage occurred). I have indicated that I believe that when I, as a private individual, cause damage to another (in this case the BV of which my partner is a partial owner), this falls under the AVP in my opinion. My intermediary responded that the company would then probably invoke 'supervision' and will not pay out.Lawyer
If the laptop is demonstrably owned by the BV, I would say that the case should fall under the AVP coverage. After all, it is a movable property of a 'third party'. In my opinion, it is not about how the laptop was used, but who the owner is.Lawyer
It's about the content of the policy. Many AVP insurance policies contain a supervision clause that actually excludes coverage, although in recent years that clause has often become somewhat milder. So read the policy carefully.Take the next step
