Dear, PA and KA amounts have been established and included in the draft covenant. KA is not a matter of discussion. Regarding PA the following: I would prefer to see it stated in the agreement that we can both provide for our own maintenance and therefore waive alimony. My future ex does not want this. Proposed text in current draft is: 'Parties are bound by a term of five years, calculated from the first of the month following the date of registration of the divorce decree in the civil registry, agreed upon for the payment of alimony. After this period has expired, the alimony obligation lapses. This is a settlement agreement.' 'If the woman earns a higher income within the five-year period, she will immediately inform the man of this and the alimony amount determined in paragraph 2.3 will be reduced by the same amount as the increase with effect from the first of the month following the date of the increase. If the increase exceeds the alimony amount, the alimony will lapse. This is a settlement agreement.' the amount of PA is calculated on current number of hours. Now she will soon make more hours. This increases her income by more than the amount of alimony. Does the above text mean that no more alimony has to be paid or does it still have to be paid for 5 years, despite the condition regarding a higher income? I would like the agreement to be as clear as possible, but I am still unsure whether or not payments have to be made for 5 years. Thanks in advance for reading and feedback.

There is already a regulation regarding the higher income so I do not see why the agreement cannot have an additional provision so that that amount is also fixed. Your ex will not waive her rights. If she can no longer generate income for herself (or vice versa) you, and a benefit is required, then the municipality will also knock on the exes' door for a supplement. Circumstances can be different tomorrow, an agreement cannot cover everything.
