Right to access under guardianship: Your questions answered
Questioner
Good day, I have a question about the right of access. I am under guardianship and am experiencing some problems with my guardian. I am therefore collecting evidence to lift the guardianship. Now my question is, can I request information from my energy supplier about whether or not payments have been made and whether I can receive a copy and/or email of this? Does this also fall under the right of access?Lawyer
Yes, you can always ask for access. The energy supplier can decide not to give you access because you have been placed under guardianship. It may be more convenient to state in your question why you want access/copy of the payments. The chance is then greater that the supplier will give you the proof you request.Questioner
According to Article 15 GDPR, I can request my data. http://www.privacy-regulation.eu/nl/artikelen-15-recht-van-inzage-van-de-betekene-EU-AVG.htm It doesn't say anywhere that they are allowed to do this because I am under protective custodyTake the next step
