Advice on Uninsured Collision - Legal Aid
Questioner
Good day, My daughter almost had a collision with a motorist. To avoid the collision she braked hard and fell. Damage to the scooter and clothing resulted. The motorist drove on after getting out to tell my daughter to be more careful. However, my daughter drove straight on and the motorist turned right. After reporting the incident to the police (because we had the license plate number), an investigation was started into 'leaving the scene after a traffic accident'. Today we were told that the investigation was being stopped because there was not enough information to track down the perpetrator. When reporting the incident, the officer indicated that he had seen in the system that the description of the motorist given by my daughter matched the description of the motorist. perpetrator was accurate and that the vehicle is not insured. How do I proceed now?!Lawyer
How awful that your daughter was hit and the owner of the vehicle in question is not insured. I hope your daughter did not sustain any injuries from the accident. Fortunately, there is a solution for these types of cases in the Netherlands. You can file a claim for damages with the Guarantee Fund. This fund was specifically set up for collisions with a motor vehicle where the perpetrator is unknown or, as in your case, the motor vehicle causing the damage is uninsured. There are a number of conditions attached to filing a claim with the Guarantee Fund. One of them is that you must file a report within 14 days. But I read that you have already done this. You can easily file the claim on the website of the Guarantee Fund. Was your daughter injured? Then I advise you to hire a personal injury lawyer. He will then file the claim for you. In this case, please feel free to contact my office without obligation. I wish you and your daughter strength and I hope that the damage will still be properly settled.Questioner
Many thanks for the advice Mr Brugman. In the meantime, the claim for damages has been submitted to the guarantee fund.Take the next step
