Legal Advice for Cancellation Insurance - Legal Advice

Questioner

Hello, I broke my ankle, and am in a cast and on crutches. I would go on holiday by car, with my wife and three children, to a (car-free) campsite in the South of France. Now my cancellation insurance says that my wife can drive, so I cannot claim on my insurance. However, I believe that I should make a claim on my insurance because I cannot do what was planned on the holiday: swimming, beach, sailing, etc. Moreover, I am now on sick leave because the occupational health and safety doctor has forbidden me from working, so I can't 'make' arrangements to go on holiday, can I? I would like your advice on what I can do to convince my insurer... Kind regards from Rotterdam.

In principle, if one of the insured persons cannot travel due to a reason stated in the policy conditions, this is covered by the cancellation insurance. However, it must concern unforeseen circumstances. It is possible that exclusions apply in your case. However, it seems unreasonable to me that there is no coverage in your case, especially considering the fact that you have to cancel your holiday. I advise you to first send a letter of complaint to the insurer after studying the policy conditions. Statements from doctors, for example, may support your complaint.
