Legal Advice for VVE Disputes
Questioner
Hello, I have been living in an apartment building for two months. On the wall of my indoor balcony/loggia I have attached a collapsible rotary clothesline. It does not stick out, there is no laundry hanging outside the building. I received a request from the homeowners' association to remove the clothesline from the wall because according to the house rules, no cupboards and/or other objects that would disrupt the appearance of the building may be placed, hung or attached to the balconies. My question is am I required to remove the drying rack? What is considered “disturbing to the appearance of the building”? PS According to the HHR, laundry should not hang outside the balcony and not drip. This is not the case, the laundry and the rack do not stick out.Lawyer
Whether something is disruptive or not is highly subjective. In any case, you are not violating the article regarding laundry. I can hardly imagine that there are no other residents who dry their laundry on the balcony. If that is tolerated with a separate drying rack, then I would stick to my guns for the time being if I were you. If you cannot resolve this with the VVE, then I may be able to help you.Questioner
