Need legal assistance with a dormant employment relationship?
Questioner
Good afternoon, My employer has been keeping me in a dormant employment relationship for a year and a half because he does not want to give me a transition payment after 14 years of employment (I now receive a full IVA benefit) Now last year, without them telling me (I heard it through a colleague), I transferred to my son's company (it has a different company name but is located in his father's business premises). I immediately indicated by email that I did not want that, but I was no exception so I had to go along. I did not receive a new contract under the name of my son's company. In recent years I have been FORCED to change my company name 3 times, all under the guise of 'financial accounting', You can't/may not say no because then you could leave, was the message. Yesterday I was told that my son is going to move his company to another building, so away from my father's business premises. I hear all this through the grapevine. So my question is: Does my employer have to keep me informed about important matters such as moving, etc.?Lawyer
It is not possible to simply transfer to another company. Correspondence can be used to assess whether you can reverse this. Furthermore, your situation is very exceptional and I advise you to terminate the employment and claim a transition payment. Your employer has not behaved as a good employer should, at least that is what I understand. If you wish, you can contact me directly.Questioner
I first asked for help through legal assistance DAS, who sent some correspondence to my employer shortly before I did, with the result: dormant employment relationship, so no transition payment! After that, a private legal agent tried to get my rights by sending a few letters to my employer, they wanted to get rid of me but I would get a lot less transition compensation than I am entitled to according to the law, I did not agree to this. I want my rights, nothing more and nothing less...so my full transition compensation! The last lawyer cost me almost 700 euros (I couldn't pay more) and unfortunately not the result I had hoped for. If I had the money I would go to court, but judges often decide in favor of the employer regarding dormant employment. Now last week the bill was approved that employers will be compensated as of 2020 via UWV so that employers no longer have to keep employees in dormant employment. 2020! Scandalous that employers can keep you in such a stranglehold, but okay, so be it..Questioner

I advise you to contact an employment lawyer who can also apply for a supplement for you. You may be eligible for that. I know a good lawyer.Take the next step
