Rights of Temporary Workers: Wage Increase and Extra Payment

Questioner

Good morning, I currently work at the employment agency where I get paid according to the hirer's remuneration. Now new collective labor agreements have been made within the company where a wage increase of 3% is implemented and a one-off amount of €450,- is provided on 1-1-2019. Am I also entitled to that extra payment as a temporary worker? Kind regards,

Lawyer

If the employment agency has determined with you that you are entitled to the hirer's remuneration, then you are indeed entitled to this wage increase and one-off incentive. See also art. 20, 21 and CAO ABU. Art. 23 CAO ABU states: Initial wage increase. In the context of the application of the hirer's remuneration as referred to in article 20, the temporary employment agency is obliged to apply the same initial wage increase to the temporary worker as applies to the employee employed by the client, working in an equal or equivalent position as the temporary worker. The amount of the initial wage increase and the time at which it is paid are in accordance with what applies to the client.
