Divorce and Pension: What now?
Questioner
Good day, We divorced over 4 years ago, a covenant was drawn up. The house was recently sold and all financial matters were settled. We drew up a document together in which we agreed that we no longer have any claims against each other and that by signing this agreement of final discharge the previously pronounced divorce has been fully settled in financial terms. My question is whether this also includes the mutual claim for pensions? Neither of them has indicated to pension funds within two years that they are using each other's pension. Yours sincerely.Lawyer
Assuming that the pension settlement has been pronounced in the divorce decree, the final settlement does not apply to the pension.Lawyer
You can read more about this on the following government website: https://www.rijksoverheid.nl/onderwerpen/scheiden/vraag-en-antwoord/verdelen-ouderdomspensioen-na-scheiding. This means that you can no longer claim directly from the pension provider after 2 years, but you can still claim from your ex-partner. I suspect that this will not be ruled out now that the courts do not allow it either.Take the next step
