Legal Advice on House Buyout & Valuation

Questioner

now we have a house and that is both of us so 50/50 he wants to buy me out and has had a valuer come without informing me. He has valued the house at an amount that is 30,000 less than the value of the house. I have had 3 real estate agents come to assess the value of the house. I did this without informing him. He wants to buy me out for too low an amount of the value of the house. What would be the best thing for me to do in this story. He is threatening with lawyers. He has another relationship, hardly ever comes home anymore, does not say where he is and whether he is abroad. He is lax with his payments so thanks to him we received a letter from the mortgage provider that the mortgage has not been paid. He is making a mess of it. What advice could you give me in this?

You were right to engage other real estate agents to determine a fair value of the property. You can present this to your ex-partner in writing using the real estate agent's valuations. You can also tell him that he must meet his mortgage obligations, although the bank will not pay much attention to this and can also approach you on the basis of joint and several liability. You do have a personal claim on your ex for the overpayment.
