Legal questions about back paths and property boundaries

Questioner

Hello. I live in a corner house with a back alley on the side and back that separates the residential blocks from each other (I don't know whether you should call it a fire alley or a back path). according to the municipality the plot boundary runs through the middle of this corridor. so the side neighbors and back neighbors are co-owners of this corridor. of approx. 1.5 meters wide. Now my question is, are you allowed to place your waste containers in this corridor? In my opinion, it does not benefit the flow and the burglary safety. the BOA says that he cannot do anything about this because it is not municipal land....

The BOA's position seems correct to me, it concerns land that is owned by the owners of the adjacent houses. In all probability, an easement was established in the past with regard to the back path, the text of which will be quoted in your title deed. There you can read which rules apply to the back path. In many cases it is stated that such a path serves to come from and go to the street and that no obstacles may be placed. If the text is not included in your title deed, the text can be requested via the land registry.
