Rights and obligations in childcare

Questioner

Hello, I work in childcare and have an 18-hour contract. During the holidays I was not called for 2 weeks (I was available) which means that I am 36 hours in the red. I am now voluntarily working extra but this with the idea of having the amount paid out and/or to compensate for a holiday (too many holiday hours taken) We work with an annual hours system. What rights and obligations do I have now?

Lawyer

The number of plus and minus hours depends on the number of hours an employee works. In other words, if you have an employment contract of 18 hours per week (78 hours per month), you may have a balance of up to 78 plus or minus hours at any time during the year. As soon as the maximum plus or minus hours have been reached, the employer must employ you less/more. Whether you can use the plus hours and “voluntarily” worked hours to compensate for the excess vacation hours taken or have them paid out depends on the individual agreements you have made with your employer.
