Legal questions about collective labor agreement increases?
Questioner
For the past 2 weeks I have had a new employer with whom I have a fixed-term contract (13-8-2018 to 31-8-2019). Now there are coa increases coming in September this year and May next year where my employer indicates that this does not apply to me because I have a fixed term contract. This is a total of 5.5% which is still very much. My contract does not state that I am not eligible for these COA increases. The collective labour agreement falls under Wholesale of Textiles and related articles. Can my employer simply implement this?Lawyer
No, that is not allowed. Everyone who has a contract with the company, indefinite or fixed term, must be treated equally. So the pay rise should also apply to you.Questioner
