Legal questions about housing division
Questioner
My partner and I have split up and I will remain in the house we bought. We have found a rental property for her. I can pay the monthly payments but I cannot get the mortgage in my name. The house will remain in both names for the time being. Now my question is whether I am obliged to buy her out. It is in both names so if I were to ever sell it, she would still be entitled to any profit.Lawyer
As long as the house is in both names, you cannot simply buy her out. The other party must agree to this. If you are living together, look at the cohabitation agreement regarding the division of the house. If you were married, the divorce agreement must state how the house is divided. Only then can you transfer the house to your name with the permission of the mortgage provider.Take the next step
