Legal Assistance for Neighborhood Disputes

Questioner

Good day, According to our purchase contract, we are responsible for 1/8 of the fire passage at the back. Now the diagonally rear neighbors have pulled a piece of the fire passage into their garden. This makes it difficult to get through with a bicycle and a mobility scooter can no longer get through at all. We are now afraid that the neighbours behind us will level their fence with the neighbours diagonally behind us. If they do this, we will no longer be able to get away with our bicycles or we will have to give up some of our back garden. Our questions: - Does what is stated in our purchase contract about the fire lane also apply to the adjacent houses on the fire lane? - Is there an agency where we can report this anonymously? We have already submitted this problem to the Land Registry and the municipality, but they only point fingers at each other. Anyway, thanks for reading.

The regulation that applies to your home is -if all goes well- also applicable to the other homes that have a share in the path. This can be checked via the land registry. Because there is a private law problem, you must enforce compliance with the arrangement yourself (possibly together with the other neighbours), if necessary via the court. The government/municipality has no involvement in such matters, nor does the land registry, this agency only administers rights, nothing more. Usually a letter from a lawyer or legal expert announcing that proceedings will be initiated if the violation is not remedied is sufficient and does not actually have to lead to legal proceedings.
