Rental agreement and municipal tax - Legal aid
Questioner
Ir/Madam, My rental agreement states that I have to pay the municipal taxes myself. Now that I have deregistered after almost 3 years and have served out my rental contract, I have received a subsequent assessment from the landlord; whether I can still pay the taxes paid by the landlord for 2016, 2017 and part of 2018. The landlord is therefore contractually entitled to pass on a (proportionate) share of these taxes. My question is however; Shouldn't this have been charged within 6 months after the calendar year (just like with service costs)? In other words, do I have to pay for 2016 and 2017?Lawyer
In principle, a limitation period of 5 years applies to municipal taxes. The landlord can therefore collect additional tax within 5 years. The service costs approach is separate from this. I advise you to make a payment arrangement with the landlord if you cannot pay the amount at once. If you cannot reach an agreement, I would be happy to look at your case.Take the next step
