Questioner

I would like to present the following situation. My 16-year-old son lives with his mother/my ex. There is a divorce agreement and a parenting plan. I pay an x amount of child support per month. Now my ex has thrown my son out on the street without financial resources. Through the intervention of youth care, my son now lives with me temporarily, until a solution is found through discussions so that my son can return to his mother. This situation has been going on for about 4 weeks now. He just started a new study and now she refuses to pay for books, etc. for my son which he needs for his studies. In addition, she does not provide my son with any living expenses. This while she receives all allowances and income for him (I pay child support, child benefit, child-related budget, etc.). Am I also currently obligated to continue paying her child support while he is living with me full time? And can she just do all this without any consequences?

Lawyer

Your son is now staying with you, so it is unreasonable for you to continue paying child support. She can continue to enforce it at this time and, for example, also submit it for collection if you fail to pay to the bailiff or the LBIO. If you wish to prevent this, you can start legal proceedings at the court in which you then request that your own maintenance obligation towards your son be set to zero, as you pay monthly to his mother. You could now also request child support from his mother now that your son is staying with you. If your son is to be registered with you, you can also apply for child-related budget and claim child benefit.
