Legal questions about chalet park? Get free advice!

Questioner

I bought a chalet on a chalet park. The land is not my property. I pay an annual amount of €2000 as park costs. There were already a number of tall trees on the land. I wonder who should take care of the maintenance of these trees and who is liable if damage occurs due to poor maintenance?

Lawyer

The owner of the land where the trees are planted and standing is responsible for its maintenance. Should damage be caused by the trees, then the owner is also liable for the consequential damage.

Questioner

Thanks for the answer. However, the manager of the chalet park responds that the regulations state that the recreational user is also responsible for the trees. The regulations state: hedges and the like must be maintained. Is this correct or should the owner of the chalet park still take care of the maintenance of the trees? The regulations do not state anything about the obligations of the owner/chalet park.
