Compensation for a day of leave that has to be taken due to the fault of others. . We ordered windows to replace old wooden frames. During the final measurement, the person suggested that instead of 2 separate windows, they would place 1 large part for the upper back side. That would be easier for them. Since it would not cost me anything extra, I agreed. I signed the order with the comment that I had not measured the dimensions since they are experts in that. for the entire installation I take 3 days off because I have to be at home. during the measurement before they remove the old one it appears that a 5cm error has been made in the dimensions, so the window does not fit, they will work on the rest in the days that were mentioned and will report back when the error has been repaired and they can place it again. I will ask questions after 1 month and also state that I now have to take leave again due to a mistake on their part and ask for the cost price for what 1 day off costs me (190 euros). in the conversation they first come up with it is force majeure, that is nonsense is my reaction you made a mistake and that now costs me money. which is not fair. also in their conditions it is not mentioned in force majeure.. . after that they continuously make it difficult and I have to keep following up. the amount that they want to pay was 150 last week now 100 euros. I stated that I would have that checked by a lawyer because I feel taken and the handling is not fair in my opinion. now I received the last email that I am given a choice with either 100 euros now or placement in 2019 when I have days off again and forfeiture of 100 euros. people easily ignore the fact that days off cost money and actually don't want to pay anything if they make mistakes.. too bad because their product is really very good. (all windows have been placed in the meantime because I only took a week off last week.) In the meantime, I agreed to the 100 euros, stating 'under protest that I would still have it tested', because next week it could be reduced again... but being honest and fair is not the answer... Can this all just happen or am I not being treated fairly here?Lawyer
In principle, you are entitled to repair and/or compensation if the repair was not carried out professionally. The days off can be claimed as damages, but then it must concern reasonable costs. I think you can save yourself the trouble of taking further legal action also because it is not certain that you will also receive the claimed amounts.Questioner
Thank you very much for the response., it was not about a repair but about damage caused by not delivering at the agreed time/day by them in the measurement. I had to take an extra day off so that they could install their frames. but good news!! the company has seen the whole story. now arrived at the decisive person in that company, revised their proposal. he has reimbursed my entire amount. for that I have of course thanked him kindly.Lawyer
