Divorce and Annuity Policy Assistance
Questioner
I got divorced in 2015. In our divorce settlement, it was agreed to split 3 annuity policies 50/50. The policies are jointly owned and in my name, I submitted papers for my ex to sign a few months after the divorce to have them split. She did not sign the division papers, some time after the divorce was completed she was of the opinion that she was entitled to more than 50% in order to take all of the inheritance from her parents that came into the community during our marriage. The lawyer-mediator told her when drawing up the agreement that this was not the case because that inheritance fell into the community. I have repeatedly insisted that she sign the equal division papers in accordance with the covenant. I found out this year that due to a policy change by the insurer, annuity policies will no longer be split from the second half of 2017. All deposits have been paid and a decision must be made as of February 2019 on the form in which the policies should be continued. We have a complete difference of opinion on how it should be continued. For example, I want to have the policies paid out earlier than they do because I am stopping work earlier. I am now being duped because she is not acting according to the agreements in the covenant. I cannot decide independently and dispose of my half of the money. My legal expenses insurance says that this matter is not covered by my policy.Lawyer
