Legal Assistance with Debt Collection and Debts
Questioner
I have a question regarding a creditor from 2012 called EDR. we have been in debt relief for almost a year now and this is now the second time that an overdue creditor comes to collect the first time it was an amount of more than 1300 euros for which we, as you will understand, have to work really hard, now the bailiff comes to collect an amount of almost 1700 euros from us, you will understand again that this is no longer possible for us! we will never get any peace and this can simply continue. My question to you is whether this is allowed, given that we had never heard of EDR collection and I don't think it even existed at the time of the claim. I personally think that this claim was simply bought over and is now being collected again.Lawyer
If the claim is from 2012 and nothing has been announced about this claim in the past period, year and months, then this claim has expired. You must therefore rely on the prescription of the claim and not make any payment, otherwise the claim is accepted. It is also advisable to have the claim specified so that you know what it is about.Questioner
The last time they contacted them, according to them, was sometime in February 2017. We ourselves have never heard of the collection agency, let alone contacted them. At that time we were busy trying to get into restructuring...they claim that there was contact with the credit bank, but without success I thinkLawyer
