Legal Advice on Hidden Defects in Real Estate
Questioner
After my mother passed away, my father became the sole owner of my parental home. However, he is severely demented. My sister is the administrator. My sister and I sold the house from 1910. Now there is a claim from the buyer due to hidden defects. Neither my father nor my sister have RB insurance. I do, but they cannot do anything, because it is not my home. What are our rights? We did not know about the defects? and can we still get legal assistance. My sister cannot do anything about the fact that my father was not insured.Lawyer
When buying an 'old' home, the buyer has a duty to investigate and no claim can be made for any defects. Also important is when the home was sold and the buyer arrived with the defects. If desired, I can assist you with further advice if you have a follow-up question.Lawyer
It also depends on the exact content of the purchase agreement; is there an age clause in the purchase agreement and does it state that the sellers have not lived in the house themselves. On the basis of such provisions you could ward off liability. If you wish, I can look into the case (and the purchase contract) with you and assist you in this case.
