Information about Silent deed of assignment
Questioner
I have heard that as of 2013 a silent deed of assignment no longer needs to be registered, is that correct?Lawyer
Assignment is the transfer of a claim that a creditor has on a debtor. In short, this is legally possible in two ways: silent and public. Silent means that a notary draws up the deed of assignment or that it is not drawn up by a notary but is registered with the tax authorities. The assignment is not yet made known to the debtor of the claim. In the case of a public assignment, this is done (the deed of assignment does not necessarily have to be drawn up by a notary or registered). Only if an assignment is public does the debtor of the claim know that he has to pay the new owner of the claim. He can then no longer pay the old owner.Take the next step
